MyDotPix Play - Terms of Service

Welcome to MyDotPix Play (the "Platform"), a video streaming portal operated by HenjuTech LLP, registered under Ministry of Corporate Affairs and operating from SSB Gate, Hapoli Ziro, Lower Subansiri, Arunachal Pradesh 791120.
("MyDotPix Play", "we", "us", or "our"). These Terms of Service (the "Terms") govern your access to and use of the Platform, including all content, features, and services provided. By accessing or using the Platform, you ("you" or "User") agree to be bound by these Terms.
Please read these Terms carefully before using the Platform.
1. Acceptance of Terms
By accessing, browsing, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy (available at https://play.mydotpix.com/terms/privacy-policy), and any additional guidelines or rules posted on the Platform. If you do not agree to these Terms, you may not access or use the Platform.
2. Description of Service
MyDotPix Play is a video marketplace specifically designed for creators and viewers in North East India. The Platform allows Users to:
Upload and Offer Content: Creators can upload, list, and offer their video content for sale or rent to other Users.
Browse and Access Content: Viewers can browse, preview, rent, or purchase video content offered by Creators.
Engage with Content: Interact with content through features such as commenting (if enabled).
Facilitate Transactions: MyDotPix Play facilitates the transactions between Creators and Viewers for the rental or purchase of video content.
MyDotPix Play acts as a platform provider and is not the creator or owner of the video content uploaded by Users.
3. User Accounts
3.1. Account Creation: To access certain features of the Platform, including uploading, selling, renting, or purchasing videos, you may be required to create a user account. You agree to provide accurate, current, and complete information during the registration process and to keep your account information updated.
3.2. Account Security: You are responsible for maintaining the confidentiality of your account credentials, including your username and password. You agree to notify us immediately of any unauthorized access to or use of your account. MyDotPix Play will not be liable for any loss or damage arising from your failure to comply with this section.
3.3. Eligibility: By creating an account, you represent and warrant that you are at least 18 years of age or have the legal capacity to enter into these Terms in your jurisdiction.
3.4. Account Termination: MyDotPix Play reserves the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to a breach of these Terms.
4. Content Ownership and Rights
4.1. User-Generated Content: Users who upload video content to the Platform ("Creators") retain ownership of their intellectual property rights in that content. By uploading content, Creators grant MyDotPix Play a non-exclusive, worldwide, royalty-free, sublicensable, transferable license to use, reproduce, distribute, display, perform, and otherwise exploit the content on the Platform for the purpose of operating, promoting, and improving the Platform and its services.
4.2. Rights Granted to Viewers: When you rent or purchase video content through the Platform, you are granted a limited, non-exclusive, non-transferable license to access and view the content for personal, non-commercial use only, subject to any specific usage restrictions set by the Creator. You may not copy, download (except as explicitly permitted by the Platform), distribute, modify, or publicly display the content without the explicit permission of the copyright owner.
4.3. MyDotPix Play Content: All content provided by MyDotPix Play on the Platform, including but not limited to the design, features, logos, and software, is owned by or licensed to MyDotPix Play and is protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, or distribute MyDotPix Play's content without our express written permission.
5. Content Guidelines and Restrictions
You are solely responsible for the content you upload, share, or otherwise make available on the Platform. You agree not to upload, share, or transmit any content that:
Is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
Infringes upon the intellectual property rights (including copyright, trademarks, patents, or trade secrets) of any third party.
Contains viruses, malware, or other harmful code.
Is unsolicited or unauthorized advertising, promotional material, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation.
Misrepresents your affiliation with any person or entity.
Violates any applicable laws or regulations, including those related to online content and data privacy.
Depicts child exploitation, bestiality, or any other form of illegal or harmful sexual content.
Promotes violence, discrimination, or hatred towards any group or individual.
MyDotPix Play reserves the right to review, remove, or refuse to display any content that violates these Terms or is otherwise objectionable, at our sole discretion and without prior notice.
6. Transactions and Payments
6.1. Pricing: Creators are responsible for setting the rental and purchase prices for their video content. MyDotPix Play may charge a transaction fee or commission on each sale or rental, the details of which will be clearly communicated on the Platform.
6.2. Payment Processing: Payments for rentals and purchases will be processed through a third-party payment gateway. You agree to abide by the terms and conditions of the chosen payment gateway.
6.3. Refunds: Refund policies will be determined by MyDotPix Play and may vary depending on the circumstances. Generally, refunds may be considered for technical issues preventing access to purchased or rented content. Specific refund policies will be posted on the Platform.
6.4. Taxes: You are responsible for any applicable taxes related to your transactions on the Platform.
6.5. Earnings for Creators: Creators will receive payment for successful rentals and purchases of their content, minus any applicable fees or commissions charged by MyDotPix Play. Payment terms and schedules will be outlined on the Platform.
7. Regional Focus: North East India
MyDotPix Play is specifically designed to promote and showcase video content from and relevant to the North East region of India. While Users from outside this region may access and use the Platform, we encourage and prioritize content and creators from Arunachal Pradesh, Assam, Manipur, Meghalaya, Mizoram, Nagaland, Sikkim, and Tripura. We may implement features and promotions specifically targeting this region.
8. Disclaimer of Warranties
THE PLATFORM AND ALL CONTENT, FEATURES, AND SERVICES PROVIDED ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.
MYDOTPIX PLAY DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT ENDORSE OR WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT UPLOADED BY USERS. YOUR USE OF THE PLATFORM IS AT YOUR SOLE RISK.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MYDOTPIX PLAY AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES) ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE PLATFORM, ANY CONTENT ON THE PLATFORM, OR THESE TERMS, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF MYDOTPIX PLAY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL THE AGGREGATE LIABILITY OF MYDOTPIX PLAY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE PLATFORM OR THESE TERMS EXCEED THE AMOUNT YOU HAVE PAID TO MYDOTPIX PLAY (IF ANY) IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.
10. Indemnification
You agree to indemnify, defend, and hold harmless MyDotPix Play and its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
Your use of or access to the Platform.
Your violation of these Terms.
Your User Content, including any claim that your User Content infringes upon the intellectual property rights or other rights of any third party.
Your interaction with other Users.
11. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts located in Ziro, lower Subansiri, Arunachal Pradesh.
12. Modifications to the Terms
MyDotPix Play reserves the right to modify these Terms at any time without prior notice. Any changes to these Terms will be effective immediately upon posting on the Platform. Your continued use of the Platform after the posting of revised Terms constitutes your acceptance of the changes. It is your responsibility to review these Terms periodically for updates.
13. Termination
MyDotPix Play may terminate these Terms and your access to all or any part of the Platform at any time, with or without cause, with or without notice, effective immediately. Upon termination, your right to use the Platform will cease immediately. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
14. Third-Party Links and Services
The Platform may contain links to third-party websites or services that are not owned or controlled by MyDotPix Play. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that MyDotPix Play shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any third-party websites or services.
15. Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices or agreements published by MyDotPix Play on the Platform, constitute the entire agreement between you and MyDotPix Play concerning the Platform and supersede all prior and contemporaneous communications and proposals, whether oral or written.
